You have been hurt on the job, you are pursuing a workers’ compensation claim, and perhaps your employer is threatening to fire you. First, your employer cannot legally fire you for suffering an injury at work. There is a specific section in the Workers’ Compensation law that says your employer cannot terminate you.
In practice, however, an employer may make it difficult for you when you return to work. If you work for a large company, you may qualify for additional protections under the Family Medical Leave Act. The FMLA provides you twelve weeks of job protection following an injury sustained in the course of your employment.
